THE PAULANER “CLEVELAND OKTOBERFEST TRIP TO MUNICH WITH PAULANER” SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN.
ELIGIBILITY: The “Cleveland Oktoberfest Trip to Munich with Paulaner” Sweepstakes (the “Sweepstakes”) begins at approximately 12:00:01 AM Eastern Time (“ET”) on 08/01/23 and ends at 11:59:59 PM ET on 09/10/23 (the “Sweepstakes Period”). Open to residents of Ohio who are 21 years of age or older at time of entry. Persons in any of the following categories are not eligible: (a) employees or former employees of (i) Paulaner USA (“Sponsor”), (ii) Sponsor’s advertising/promotions agencies, (iii) alcoholic beverage licensees, (iv) the parent, subsidiary, and affiliated companies of the foregoing, (b) persons who are immediate family members of, or who reside in the same household as, any person in the preceding categories and (c) anyone who has won a national sweepstakes sponsored by Paulaner USA in the 18 months prior to the commencement of the Sweepstakes Period. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor.
HOW TO ENTER: There are two ways to enter the Sweepstakes: (1) During the hours of the 2023 Cleveland Oktoberfest event to be held from September 1, 2023, to September 9, 2023, at the Cuyahoga County Fairgrounds (the “Fairgrounds”) in Middleburg Heights, Ohio (just outside of Cleveland), complete an entry form on one of the specially designated Apple iPads located throughout the Fairgrounds. Entrants must provide their name, residence street address (PO Boxes are NOT acceptable), city, state, zip code, email address, telephone number, and date of birth. (2) Between 08/01/23 and 09/10/23, visit clevelandoktoberfest.com/sweeps, follow the instructions to enter the Sweepstakes, and provide your name, residence street address (PO Boxes are NOT acceptable), city, state, zip code, email address, telephone number, and date of birth. You may enter only once per day regardless of the method of entry. If multiple entries are received from the same person on any one day, only the first entry will be accepted. No purchase is necessary to enter or win.
NOTIFICATION AND PRIZE: On or around 09/14/23, one (1) winner (“Winner”) will be randomly selected from all eligible entries received during the Sweepstakes Period. The Winner will receive the following prize package (the “Prize”): (i) two (2) tickets (one for the Winner and one for the Winner’s guest (“Guest”)) for one day or evening as Sponsor’s VIP guest at the 2024 Oktoberfest in Munich, Germany (the “Festival”), (ii) roundtrip coach airfare for the Winner and Guest from the international airport in the continental United States that is closest to the Winner’s residence (as determined by Sponsor) to Munich, Germany, and (iii) two (2) consecutive nights hotel stay in Munich, Germany (Sponsor to select hotel and accommodations which will include one standard room with double occupancy and morning breakfast). The Approximate Retail Value (ARV) of the Prize is $3,500. Tickets will be for attendance at the 2024 Oktoberfest for one afternoon or one evening between September 21, 2024 and October 6, 2024. Sponsor will attempt to accommodate the Winner’s schedule, but Sponsor cannot guarantee any specific date of attendance. Any and all other costs and expenses not specifically mentioned herein including, but not limited to, all taxes, additional transportation, passports, additional hotel stay, fuel, insurance, meals, beverages, gratuities, room service, other services, upgrades, souvenirs, and personal expenses, are the sole responsibility of the Winner and Guest. No alcohol is being awarded as a Prize. Sponsor reserves the right, at its sole discretion if Sponsor encounters problems with awarding the Prize as described, to substitute the Prize with one of equal or greater value which may or may not be a trip to a future Munich Oktoberfest. In the event there is a difference between the actual value of the Prize and the stated ARV of the Prize, there will be no refund or reimbursement provided. Winner will be notified by phone or email and is subject to confirmation of eligibility.
PRIZE CONDITIONS: Prize must be used only for the event as described. Winner and Guest must provide a copy of their valid passports to Sponsor no later than by June 30, 2024, or the Prize will be forfeited in its entirety. Winner must provide his/her Social Security number as a condition of receiving the Prize and will be issued an IRS Form 1099. All components of the Prize must be used in one trip. Winner and Guest must travel together and use the Prize on the same days/nights. Prize is not transferable, cannot be sold or auctioned, and has no cash surrender value. In the event that the Winner does not use any portion of the Prize, there will be no reimbursement or compensation provided. Winner and Guest must be 21 years of age or older. Guest has no independent rights to the Prize or any portion thereof. If Sponsor is unable to receive personal confirmation from the Winner of being selected as the Winner within 5 days from Sponsor’s first notification attempt, or if the Winner (i) fails to complete and return all requested documents, including but not limited to, a copy of passports by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with these Official Rules, the Winner will be disqualified, the Prize will be forfeited, and an alternate winner may be selected if time permits. If a selected Winner declines the Prize for any reason, Sponsor will use reasonable efforts to continue to select a replacement Winner as long as time permits and the resulting delays do not affect the cost of the Prize. Prize good only for the 2024 Oktoberfest to be held in Munich, Germany. The acceptance or use of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. A purchase will not increase chances of winning. Participants who are unwilling to fly to Germany to attend the Festival because of health, safety, or other concerns should not enter the Sweepstakes as no cash alternative to the Prize is available. Winner and Guest must have all identification and other documents necessary for travel including, if required for international travel to Germany, documents showing personal vaccinations and/or proof of negative COVID testing. In the event the 2024 Festival is cancelled or rescheduled, Sponsor will substitute the Prize, in its sole discretion, with one of equal or greater value.
LIMITATIONS ON LIABILITY: Entrants waive any right to claim ambiguity with regard to the mechanics of the Sweepstakes or interpretation of the Official Rules. Sponsor and its agents and their respective officers, directors, and employees are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for any electronic, network, or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions that may limit a user’s ability to participate in this Sweepstakes, or for any other hardware, software, or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Sweepstakes, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, or with respect to any Sweepstakes-related materials. All entries become the property of the Sponsor. Headings are provided for convenience only. Sponsor is not responsible or liable for any loss, injury (including death), damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, air or ground transportation carriers and any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God. The Winner and Guest may be required to sign additional Releases as a condition of use of the Prize. Winner and Guest agree to release, discharge, indemnify, and hold harmless the Sponsor and its parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages, or losses claimed by any person, including the Winner and Guest, as a result of the Winner entering the Sweepstakes, submitting an entry, or using the Prize. Sponsor is not liable for the actions of the Winner and Guest while using the Prize, and Winner and Guest (i) are responsible for their own behavior while using the Prize, (ii) are subject to the rules of the event organizers, and (iii) agree that each may be ejected from the venue for unruly behavior. No refund or compensation will be provided if the Winner and/or Guest is asked to leave the hotel, the Festival, or any other location as a result of unruly behavior. The Sweepstakes is subject to all applicable federal, state, and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of the Sweepstakes will be declared ineligible and may be prosecuted. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes, or award the Prize through a random drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause. Any disputes regarding this Sweepstakes shall be governed by New York law and resolved in courts located in Westchester County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorney fees. Entrant waives any claim for punitive, incidental, or consequential damages. With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose.
